These Terms of Service ("Terms") govern your use of getndial.com (the "Site") and the consulting, compliance, marketing, web development, and related services delivered by Get N Dial Info Service Pvt Ltd ("Get N Dial," "we," "us"). By using the Site or engaging us for a service, you agree to these Terms. If you don't agree, please don't use the Site or engage us. These Terms are governed by the laws of India and the courts at Malappuram, Kerala have jurisdiction over any disputes.

1. About Get N Dial and our services

Get N Dial Info Service Pvt Ltd is a private limited company registered in India (CIN: U74300KL2014PTC036101, GSTIN: 32AAFCG5839D1ZT) with its office at 2nd floor, Karimbanakkal Building, Thrissur Road, Edappal, Malappuram, Kerala 679576.

We provide consulting and facilitation services across 6 pillars:

  1. Barcode registration (EAN-13, UPC-A; non-GS1 unless explicitly purchased as GS1)
  2. ISO certification consulting (9001, 14001, 22000, 27001, others)
  3. Business legal services (GST, MSME, FSSAI, trademark, copyright, IEC, HALAL, company registration)
  4. Digital marketing (Google Ads, Meta Ads, WhatsApp automation, SEO, social, lead-gen)
  5. Web development (sites, apps, ecommerce, hosting, email, domain, SSL, maintenance)
  6. Creative branding (concepts, naming, logo, brochures, video, content)

What we are not: We are not a Chartered Accountancy firm, a law firm, or a certifying body. For services that require a CA or a lawyer's certification, we coordinate with empanelled professionals, separately disclosed in the engagement letter. For ISO certification, the certificate is issued by the certification body (named on the engagement letter), not by Get N Dial.

2. Your responsibilities

When you engage us for a service, you agree:

  1. To provide accurate information. The documents and details you give us must be true, current, and complete. If we file a wrong document because you gave us a wrong PAN number, the consequences (rejection, re-filing fees, government penalty) are on you.
  2. To provide documents you are entitled to use. If you ask us to apply for a trademark, the brand must be yours to apply for. If you ask us to register a business, the directors / proprietors named must consent. We are not in a position to audit your title.
  3. To use our services lawfully. Do not engage us to evade taxes, file false declarations, or misrepresent your business. We will refuse the engagement and report it where law requires.
  4. To respond on time. Most government processes have document submission deadlines. If we ask you for a clarification or an additional document and you take 3 weeks to reply, the timeline resets.
  5. To pay on the agreed schedule. See section 4.

3. Service delivery and timelines

3.1 Timelines are estimates. Every service page on getndial.com states an indicative timeline (for example: "ISO 9001, typically 18–24 working days"). These ranges are based on our historical delivery data and assume:

3.2 We do not control government bodies. Where a service depends on a government portal or a third-party certifying body (GST portal, FSSAI, Trademark Registry, Bureau of Indian Standards, ISO certification body, etc.), their processing time is outside our control. If the GST portal is down for 3 days, our timeline extends by 3 days. We will not charge you extra for delays caused by third parties.

3.3 Communication. We will send you status updates at the milestones agreed in the engagement letter. For most services, milestones are: (a) documents received and verified, (b) application filed, (c) acknowledgement / SRN received, (d) approval / certificate issued.

3.4 Substitution. If a specific team member is unavailable (leave, illness), we may substitute another qualified team member without reducing the quality of service. We will tell you when this happens.

4. Payment

4.1 Advance and milestones. For smaller engagements, the entire service fee is payable in advance. For larger engagements (web development, multi-service bundles, ISO certification with audit), payment is split into milestones agreed in the engagement letter: typically 50% advance, 30% on filing / draft delivery, 20% on completion. The breakpoint between the 2 structures is noted in the engagement letter.

4.2 Government fees are separate. The "Our consulting fee" amount on each service page does not include government fees, certifying body fees, or third-party charges. These are passed through to you at actual cost and are typically paid directly to the government or third party; they are not a Get N Dial revenue line. We disclose them on the engagement letter before you commit.

4.3 Taxes. All fees quoted are exclusive of GST unless explicitly stated. Current GST applies as per Indian law.

4.4 Invoices and receipts. Tax invoices are issued within 7 days of payment. Receipts are sent by email and WhatsApp.

4.5 Late payment. If a milestone payment is more than 14 working days overdue, we will pause work until payment is received. The timeline extends accordingly.

4.6 Refunds. Refund terms are set out in our separate Refund Policy, which forms part of these Terms.

5. Intellectual property

5.1 Site content. All content on getndial.com (text, graphics, logos, photos, the Get N Dial wordmark and pill mark) is owned by Get N Dial Info Service Pvt Ltd or its licensors and protected by the Copyright Act 1957 and the Trade Marks Act 1999. You may not reproduce, distribute, or create derivative works without our written permission. Exceptions:

5.2 Client materials. Any content you provide us (your logo, product images, brand name, business documents, copy briefs) remains your property. By providing them to us for a service, you grant us a limited licence to use them solely to deliver that service. We do not use your materials for marketing without your written permission.

5.3 Work product. Custom work product we deliver (website code, brochure designs, logo files, ad creatives) belongs to you once the engagement is paid in full. Until then, it belongs to us. Underlying frameworks, libraries, and tools we use across clients (e.g., our standard hosting stack, CMS templates, ad-account audit checklists) remain ours.

5.4 Portfolio rights. We reserve the right to include your engagement in our portfolio (client logo on the homepage, anonymised case study) unless you opt out in writing in the engagement letter.

6. Limitations of liability

6.1 Honest scope. We will perform the service with reasonable care and skill. We do not guarantee a particular government outcome: for example, that a trademark application will be granted, that an ISO certificate will be issued, or that a barcode will be accepted by every retailer. Government bodies and third-party certifiers make their own decisions.

6.2 Our liability cap. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to a service engagement is limited to the service fee paid by you for that specific engagement (excluding government fees and third-party pass-through costs). This cap applies to direct and indirect claims, in contract, tort, or otherwise.

6.4 What we are liable for. Mistakes that are clearly our doing: wrong information typed into a form by us, missed deadlines on a paid service where the cause is on our side, breach of confidentiality. In those cases, we apply the refund framework in the Refund Policy and the liability cap in 6.2.

7. Termination

7.1 By you. You may terminate an engagement at any time by emailing info@getndial.com. Refunds are governed by the Refund Policy.

7.2 By us. We may terminate or refuse an engagement if:

7.3 Effect of termination. On termination, we hand over all work product paid for, return your originals, and delete data per the retention schedule in the Privacy Policy.

8. Disputes

8.1 Try us first. If you have a dispute, contact us at info@getndial.com with the subject "Dispute." We will respond within 7 working days and try to resolve it within 30 working days.

8.2 Mediation. If we cannot resolve it directly, both parties agree to attempt mediation via a mutually agreed mediator in Malappuram or Thrissur district before commencing litigation.

8.3 Governing law and jurisdiction. These Terms are governed by Indian law. The courts at Edappal / Malappuram, Kerala have exclusive jurisdiction over any disputes that cannot be resolved by mediation.

9. Force majeure

Neither party is liable for delay or failure to perform when caused by events beyond reasonable control, including but not limited to acts of God, floods (relevant in Kerala), pandemics, government shutdowns of relevant portals, internet or power outages affecting Edappal, war, or strikes. The affected party will notify the other party and resume performance as soon as practicable.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated as set out in the Privacy Policy section 12. The "Last updated" date at the top reflects the latest revision. Continued use of the Site or engagement of our services after the change date constitutes acceptance.
